On Tuesday, January 28, 2025, the first investigating judge at the Financial Judicial Pole decided to extend the pretrial detention of former Truth and Dignity Commission (TDC) President Sihem Bensedrine for an additional four months, pending the case against her.
The Financial Judicial Pole had previously issued a warrant for Bensedrine’s imprisonment on charges of fraud in the preparation of the TDC’s final report, which documented human rights violations over the past decades and was part of the transitional justice process in Tunisia. This raises concerns that the legal proceedings launched against her based on a complaint by a member of the TDC may be vindictive and malicious, given that the TDC had been pursuing former officials from the Ben Ali regime who committed crimes or serious human rights violations.
It is noteworthy that Ben Sedrine was transferred to hospital after going on a hunger strike that has lasted 13 days in protest against her arrest, which raised widespread concerns about her health condition. Local and international human rights organizations have called for her release and to enable her to exercise her rights to a fair trial, while ensuring her physical and psychological safety inside prison.

The Freedom for Tunisia Observatory expresses its deep concern about the continued detention of Sihem Ben Sedrine for ab extended period without a final trial, with her health condition worsening due to her hunger strike. It also calls for:
Ensuring urgent medical care for her, in accordance with international standards.
An independent legal review of the conditions of her detention and the charges against her.
Ensuring a fair trial away from any political exploitation of the judiciary.
The Observatory warns that the continuation of such measures constitute a serious violation of human rights, which may require international prosecution and human rights action to ensure respect for fair legal standards.
