On Tuesday, November 26, 2024, the criminal chamber of the Tunis First Court of Instance rejected the bail application of the former first president of the Court of Cassation, Tayeb Rached, and postponed the consideration of his case until next December.
The charges against Tayeb Rached are related to suspicion of financial and administrative corruption during his tenure as the first president of the Court of Cassation. In this context, the Charging Chamber specialised in financial corruption cases at the Court of Appeal in Tunis, ruled to dismiss the request to dismiss charges for lack of evidence in the case related to forming an illegitimate agreement and bribery.
Tayeb Rached’s defense team insisted that their client denies all charges against him, stressing that measures that have been taken against him contravene the most basic legal procedures. They increased that their client is fully cooperating with investigators to prove his innocence.
It is worth noting that Tayeb Rached was relieved of his duties as president of the Court of Cassation as part of the anti-corruption campaign launched by the Tunisian authorities.
The Freedom for Tunisia Observatory expresses its concern over the continuing detention of Tayeb and the postponement of the consideration of his case, and stresses the importance of respecting the rights to a fair trial within reasonable deadlines, and ensuring that judicial measures are not used for political pressure or retribution.
