Political activist Mosaab Gharbi, who has been detained since July 13, 2024 in Oudhna prison, announced that he will begin an open hunger strike starting January 14, 2025, in protest against his continued detention without trial or providing any evidence against him. Gharbi was arrested along with the Secretary-General of the Ennahdha Movement, Ajmi Lourimi, and Shura Council member Mohamed Ghanoudi, during a routine identity check on the road, where they were charged with “covering up for a person wanted by judicial authorities” despite the fact that they had no prior knowledge of the existence of a search warrant issued against them or a judicial investigation against them.
Violation of judicial standards:
The Observatory for Freedom in Tunisia expresses its deep concern about the legal violations in this case, especially with regard to the failure to set a date for Gharbi’s trial and his continued detention without a clear legal basis. This situation constitutes a flagrant violation of international fair trial standards and is considered arbitrary detention that contravenes human rights principles.
Call for Action:
The Freedom for Tunisia elObservatory calls on the judicial authorities to abide by legal standards and immediately release Mosaab Gharbi, or bring him to a fair trial as soon as possible. The Observatory also appeals to national and international human rights organizations to intervene and follow up on this case to ensure respect for human rights in Tunisia.
Note:
The Freedom for Tunisia Observatory stresses that the continued detention of individuals without trial or conclusive evidence undermines confidence in the judicial system and poses a threat to the rule of law. Therefore, the Tunisian authorities must take the necessary measures to guarantee the rights of detainees and to apply justice transparently.
