The 14th Criminal Chamber of the Court of Appeal in Tunis ruled on Tuesday, November 26, 2024, to sentence the leader of the Popular Republican Union party, Lotfi Mraihi, to six months in prison, on charges of “using information and communication systems to publish and promote false news.” This ruling came after the Public Prosecution appealed a preliminary ruling that had sentenced him to six months in prison with a suspended sentence, based on video recordings that Mraihi posted on social media.
Previous legal proceedings and targeting during the presidential elections
Lotfi Mraihi, known for his opposition positions, had faced legal proceedings during the previous presidential elections, where he was accused of buying votes and was banned from running for life in the elections in July 2024. The police also arrested him on charges of money laundering after he announced his intention to run in the presidential elections scheduled for October 2024. Mraihi described these measures as “systematic political targeting” aimed at obstructing his participation in the political scene.
Comment by the “Freedom for Tunisia” Observatory
The “Freedom for Tunisia” Observatory believes that the verdict against Lotfi Mraihi raises serious doubts about the independence of the judiciary in Tunisia, especially in light of the escalation of judicial proceedings against opposition figures. The Observatory expresses its concern about the exploitation of charges such as “spreading false news” to restrict freedom of expression and target opponents. The Observatory also calls for a review of these verdicts and ensuring respect for human rights and the principles of a fair trial, while stressing that the protection of freedom of expression and political criticism are essential pillars of the rule of law and democracy.
